Terms of Use — MyAIDictation

    Note: These Terms cover both the currently shipping free version of MyAIDictation and the upcoming MyAIDictation Pro subscription tier (launching in a future app update). Pro-specific provisions (Section 3 subscription terms, Section 4 Cloudflare service references) take effect when Pro becomes available.
  

1. Agreement to These Terms

MyAIDictation ("the App") is developed and operated by Jacob L. Wyers, an individual ("I," "me," or "Developer"). By downloading, installing, or using the App, you agree to be bound by these Terms of Use. If you do not agree, do not use the App.

These Terms apply to all users of the App, regardless of how you access it.

2. What the App Does

MyAIDictation is an iOS keyboard extension available in two tiers:

Free tier — included with the app:

Built-in on-device voice transcription through Apple's Speech framework
Optional local Parakeet transcription after the model is downloaded
On-device neural autocorrect and word prediction (no internet required)
Text expansions, learned words, and local keyboard customization

Pro tier — optional auto-renewing subscription:

Managed cloud voice transcription and AI cleanup
The AI ghost-editor that catches typos iOS autocorrect misses
All dictation cleanup styles (Casual, Professional, Summary, Verbatim, Gen-α, Custom)
Premium keyboard customization including animated themes, adjustable keyboard size, optional number row, and premium haptics

Free-tier on-device transcription and autocorrect require no payment to me. Pro cloud transcription and AI cleanup require an active subscription and an internet connection.

3. Pricing, Subscription & Refunds

The App is free to download from the Apple App Store. The Pro tier is available as an auto-renewing monthly subscription at $3.99 USD (or local equivalent).

Free trial. New subscribers receive a 7-day free trial. Your payment method is charged at the end of the trial unless you cancel at least 24 hours before the trial ends.

Auto-renewal. The subscription renews automatically at the end of each monthly period unless you turn off auto-renewal at least 24 hours before the end of the current period. Payment is charged to your Apple ID account at confirmation of purchase and at each renewal. You can manage and cancel your subscription at any time in your Apple ID account settings (Settings → [your name] → Subscriptions on iOS).

Refunds. All purchases and subscriptions are processed by Apple Inc. and are subject to Apple's refund policies. I have no ability to issue refunds directly — all refund requests must be submitted to Apple through the App Store. Unused portions of a free trial are forfeited when a subscription is purchased.

Price changes. I may change the subscription price at any time, but any change will only apply to subsequent renewals and will be communicated in advance as required by Apple's developer guidelines. You may cancel before the next renewal if you do not accept the new price.

      Pro cloud features depend on third-party AI infrastructure and an active internet connection. Local typing features, built-in on-device dictation, and downloaded Parakeet transcription can continue without those cloud services.
    

4. Third-Party Services

The App relies on third-party services to deliver certain features:

Cloudflare, Inc. — managed cloud voice transcription, AI text cleanup, and the AI ghost-editor for Pro subscribers, routed through Cloudflare's AI Gateway, Workers, and Workers AI products. Your use of these Pro features is subject to Cloudflare's Website Terms and Cloudflare's Privacy Policy.
Apple Inc. — App Store distribution, in-app purchase processing, subscription billing, and iOS platform. Your use of the App is also subject to Apple's standard end-user license agreement.

I am not responsible for the availability, accuracy, security, or conduct of any third-party service. If a cloud provider changes or discontinues its service, cloud transcription and AI cleanup features may be affected without notice from me.

5. Local and Cloud Features

Local features run on your device and may depend on Apple system permissions, installed models, available storage, and device performance. Cloud features require an active internet connection and may be unavailable during provider outages, rate limits, maintenance, or other service disruptions.

You are responsible for using cloud transcription and AI cleanup features only where you have the right to record, process, or transmit the relevant audio or text.

6. Acceptable Use

You agree not to use the App to:

Violate any applicable local, state, national, or international law or regulation
Transmit any content that is unlawful, harassing, defamatory, or fraudulent
Attempt to reverse-engineer, decompile, or extract the source code of the App
Interfere with or disrupt the App, its servers, or any connected services
Use the App in any way that abuses, overloads, or attempts to bypass limits on connected cloud services

7. Ownership & Permitted Use

The App is the work of Jacob L. Wyers. Your purchase gives you the right to use the App on Apple devices you own or control for your own personal, non-commercial purposes.

You may not resell, redistribute, or otherwise make the App available to others. You may not reverse-engineer or decompile the App.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, I DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

I do not warrant that the App will be uninterrupted, error-free, or that defects will be corrected. AI-generated corrections and transcriptions may contain errors — you are responsible for reviewing and verifying any output before relying on it.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JACOB L. WYERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ANY CASE, MY TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID FOR THE APP OR ITS SUBSCRIPTIONS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIVE U.S. DOLLARS ($5.00 USD).

10. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Arkansas, without regard to its conflict-of-law provisions.

Any dispute arising out of or related to these Terms or your use of the App shall be resolved exclusively in the state or federal courts located in Arkansas, and you consent to personal jurisdiction in those courts.

11. Changes to These Terms

I may update these Terms from time to time. When I do, I will update the effective date at the top of this page. Continued use of the App after any changes constitutes your acceptance of the revised Terms.
